Ebb & Glow Daily is owned and operated by Gibson Skill Development and Training Center LLC ("we", "us", or "our"). When you use this service, you are contracting with Gibson Skill Development and Training Center LLC. Our trading name is Ebb & Glow Daily.

Acceptance of terms

By accessing or using Ebb & Glow Daily, you agree to be bound by these Terms & Conditions, including the Dispute Resolution section below, which requires you to first attempt to resolve issues informally with us and then to resolve unresolved disputes through binding individual arbitration instead of in court, and which waives your right to a jury trial and to participate in class actions. If you do not agree, please do not use the service. Continued use after we post changes means you accept the revised terms.

About the service

Ebb & Glow Daily is a personal wellness companion that helps you track daily energy, focus, and burnout signals and receive routine tips. It is a self-help and self-tracking tool, not a medical, mental health, nutrition, or fitness service.

Account responsibilities

You must provide accurate information and keep your account credentials secure. You are responsible for activity that happens under your account. You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the service.

Acceptable use

You agree not to misuse the service. Prohibited conduct includes: using the service for unlawful purposes; fraud or spam; infringing intellectual property rights; interfering with our security or systems; reverse engineering; scraping; or distributing viruses or malware.

Intellectual property

Ebb & Glow Daily, its content, designs, code, branding, and other materials are owned by Gibson Skill Development and Training Center LLC and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service for personal, non-commercial purposes in accordance with these terms.

Payments and subscriptions

Some features require a one-time premium purchase. Our order process is conducted by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms.

Refund policy

We offer a 30-day money-back guarantee for premium purchases. If you are not satisfied, you may request a refund within 30 days of your order date. Refunds are processed by Paddle. You can request a refund through paddle.net or by contacting us at hello@ebbandglowdaily.com.

Service level

We aim to keep the service available and reliable, but we do not guarantee uninterrupted or error-free performance. Maintenance, updates, and factors outside our control may affect availability.

Termination and suspension

We may suspend or terminate your access if you materially breach these terms, fail to pay amounts due, create a security or fraud risk, or repeatedly violate our policies. Upon termination, your right to use the service ends immediately, and your data may be deleted in accordance with our Privacy Notice.

Disclaimer of warranties

The service is provided "as is" without warranties of any kind, either express or implied, to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability and fitness for a particular purpose. The wellness content is general information, not personalized advice.

Limitation of liability

To the extent permitted by law, our aggregate liability is limited to the amount you paid for the service in the 12 months before the claim. We are not liable for indirect, consequential, special, or punitive damages, including lost profits or data, unless prohibited by law.

Governing law

These terms are governed by the laws of the United States and the Commonwealth of Massachusetts, without regard to conflict of laws principles.

Dispute resolution — informal resolution first, then binding arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.

Step 1 — Informal resolution with the app provider. Before starting any formal proceeding, you agree to first contact us at hello@ebbandglowdaily.com and give us a written description of your issue, your contact information, and the resolution you are seeking. You and Gibson Skill Development and Training Center LLC agree to attempt in good faith to resolve the dispute informally for at least sixty (60) days before either party may proceed to arbitration.

Step 2 — Binding individual arbitration. If the dispute is not resolved during the informal period, you and Gibson Skill Development and Training Center LLC agree that any dispute, claim, or controversy arising out of or relating to these terms or the service will be resolved exclusively by final and binding individual arbitration, and not in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and may be conducted remotely, in writing, or in a mutually agreed location. Judgment on the award may be entered in any court of competent jurisdiction.

No court, no jury, no class actions. You and we waive any right to a trial by judge or jury, and waive any right to participate as a plaintiff or class member in any class, collective, consolidated, or representative action. Disputes must be brought in each party's individual capacity.

Exceptions. Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or equitable relief in a court of competent jurisdiction in Massachusetts to protect intellectual property or account security.

Opt out. You may opt out of this arbitration agreement by emailing hello@ebbandglowdaily.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these terms. If you opt out, disputes will instead be resolved in the state or federal courts located in Massachusetts.
